"Kaztemirtrans" Joint-stock Company hereinafter referred to as the Purchaser, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of the purchase of solid-metal open wagon. The Purchaser now invites sealed tenders from suppliers for the following contracts to be funded from part of the proceeds of the loan: • Lot No. 1 Delivery of solid-metal open wagon at station Ekibastuz station Semipalatinsk, station Kokshetau, station Kushmurun – 150 units; • Lot No. 2 Delivery of solid-metal open wagon at station Ekibastu station Semipalatinsk, station Kokshetau, station Kushmurun z – 150 units; • Lot No. 3 Delivery of solid-metal open wagon at station Ekibastuz station Semipalatinsk, station Kokshetau, station Kushmurun – 150 units; • Lot No. 4 Delivery of solid-metal open wagon at station Ekibastuz station Semipalatinsk, station Kokshetau, station Kushmurun – 150 units; • Lot No. 5 Delivery of solid-metal open wagon at station Ekibastuz station Semipalatinsk, station Kokshetau, station Kushmurun – 150 units; • Lot No. 6 Delivery of solid-metal open wagon at station Ekibastuz station Semipalatinsk, station Kokshetau, station Kushmurun – 150 units; • Lot No. 7 Delivery of solid-metal open wagon at station Ekibastuz station Semipalatinsk, station Kokshetau, station Kushmurun – 142 units; Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country. Tenders are invited for one or more lots. Each lot must be priced separately. Tenders for more than one lot may offer discounts and such discounts will be considered in the comparison of tenders. To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria: (a) Submission of an appropriate evidence of possession, production capabilities or, if the tenderer is not a manufacturer, an appropriate authorisation from the manufacturer(s) for the delivery of solid-metal open wagon to the Republic of Kazakhstan, in case when the tenderer is not the manufacturer thereof; (b) Submission of an appropriate evidence stable financial situation, technical and production capabilities required to perform the Contract and evidenced with information about technical and production facilities and the audited balance sheets for the last 3 years demonstrating the soundness of the tenderer's financial position, showing long-term profitability. (c) Successful experience of supply of freight wagons, including those which can be run fully loaded or empty at a speed of 120 km/h to other Purchasers in the past three (3) years, supported by information on Purchasers of such freight wagons for the last three (3) years; previous experience in the implementation of at least two similar in nature and complexity contracts for supply of freight wagons over the last three (3) years. All tenderers shall have the legal capacity and shall not be the subject of insolvency or liquidation procedures. A tenderer incorporated within the territory of the Republic of Kazakhstan shall have no indebtedness in respect of tax payments against the budgets at any levels. The conformance to the above-mentioned requirements shall be evidenced with a copy of the original certificate of registration of such company and the written declaration of the tenderer signed by its authorized representative and certified with the corporate seal. All tenders must be accompanied by a tender security in the amount of: Lot No. 1 - US $ 140 000 Lot No. 2 - US $ 140 000 Lot No. 3 - US $ 140 000 Lot No. 4 - US $ 140 000 Lot No. 5 - US $ 140 000 Lot No. 6 - US $ 140 000 Lot No. 7 - US $ 140 000 Tender documents may be obtained from the office at the address below every business day (except for Saturday and Sunday) from 9.00 to 19.00 upon presentation of a power of attorney to the duly authorized representative of the prospective tenderer; alternatively, tender documents are available at the website: www.zakupki.kazcargo.kz. Tender documents are provided free of charge. Tenders must be delivered to the office at the address below on or before 13-00 local time on 23 august, 2011. Tender documents will de opened at the same date at 15-00 in the presence of those tenderers' representatives who choose to attend. The tender documents shall be made available in Russian Language. If requested, the documents can also be made available in English at no extra cost to the tenderer. In the event of discrepancy between the English and the Russian versions, the Russian version shall prevail. The Purchaser is prepared to revise the size of lots as well as extend the deadline for tenders' submission should these and any other proposed conditions of tendering are reasonably considered to be restrictive by the market in the relevant request from a tenderer.
